:Opportunism impacts the behavior of firms in market situations where they purchase goods and services externally and create dependency relationships with other firms. Opportunism as a business issue is addressed in economics and marketing literature as an important factor in transaction cost analysis and market governance. Management and business ethics scholars, however, do not address this issue in depth, if at all.The recent bankruptcy of MCI WorldCom highlights some of the risks inherent in a world economy where customers and companies (...) of one society are dependent upon the business practices of partner companies in other societies. Telecommunications customers and companies in Asia, Europe and other places, who depended upon MCI WorldCom for connections to North America, now have important areas of their business in jeopardy because of the uncertainty about the fate of a critical business partner.MCI WorldCom’s situation appears to be the result of an attempt to obtain personal gain, at the expense of others, by at least one senior manager. This is called opportunism. Williamson defined opportunism as “self-interest seeking with guile.” It can wreak havoc with companies, customers, stock markets and economies and is demonstrated regularly in press accounts of misstatements on financial reports and other ways senior managers use their positions to enhance their personal wealth and influence.This paper will focus on the ethical issues surrounding business relationships and how Confucianism, with its focus on trust, reciprocity and mutual benefit in relationships, can offer a moral foundation to the inter-firm arrangements that are so much a part of the contemporary business landscape. A major focus of ethical argumentation is determining the relative merits of proposed ethical systems. Nevertheless, even the demonstration that a given ethical system was the one most likely to be correct would not establish that an agent should act in accord with that system. Consider, for example, a situation in which the ethical system most likely to be valid is modestly supportive of a certain action, whereas a less plausible system strongly condemns the same action. Should the agent perform (...) the action, arguing that the most plausible system supports doing so, or avoid the action, being conservative about the strong condemnation of it from a less plausible system? I argue that, in general, different ethical frameworks see the ethical world in fundamentally different ways, rendering the comparison of degrees of support and opposition of actions between systems intrinsically invalid. One should indeed choose to act in accord with the most defensible system. I believe that this important topic needs more attention than it has gotten to date. (shrink)

Climate change represents a significant challenge to the entire planet and its inhabitants. While few, if any, will be able to escape totally the effects of climate change, it will fall most heavily, at least initially, on the poor, regardless of where they reside. We may observe already possible scenarios. The tragic situation in Darfur may be less an ethnic conflict and more a clash between marginal farmers and herdsmen in an increasingly more arid local climate. More powerful storms on (...) the scale of hurricane Katrina, which affected the poor more than other economic groups, may become commonplace. The alteration of the maple sugar cycle may be a harbinger of stress on the world’s flora and fauna that humanity depends upon. Mainstream climatologists have concluded that human behavior, primarily the effects of industrialization, causes human-induced climate change. Left unchecked climate change will have serious consequences for humanity, especially the poor. Business, the primary agent of industrialization, is both the problem and the solution. This paper will apply the ethics of philosophers John Rawls (the difference principle), Robert Nozick (the Lockean Proviso, climate is a natural resource), and Aristotle, along with the work of strategist Michael Porter. Understanding how climate change management fits into a firm’s strategic opportunity will contribute to the ability of business to develop the technologies and business processes necessary to cope with climate change. The paper will conclude with a brief discussion of GE’s Ecomagination program as an example of a promising moral response to climate change. (shrink)

This case study examines five dimensions of the 2007–2009 financial crisis in the United States: the devastating effects of the financial crisis on the U.S. economy, including unparalleled unemployment, massive declines in gross domestic product, and the prolonged mortgage foreclosure crisis; the multiple causes of the financial crisis and panic, such as the housing and bond bubbles, excessive leverage, lax financial regulation, disgraceful banking practices, and abysmal rating agency performance; the extraordinary efforts of the Federal Reserve, the Federal Reserve Bank (...) of New York, and the Department of the Treasury to stem the financial freefall triggered by the crisis and resuscitate financial institutions, the ethical implications of the unprecedented actions by government institutions to rescue financial institutions and drag the country back from the brink of global financial collapse, and the conduct of the various parties contributing to the financial crisis, such as the shoddy behavior of mortgage brokers, the massive securitization of mortgages into overly complex bonds, the excessive leverage of financial institutions, the disgraceful work of bond rating firms, the abysmal risk management systems employed by financial institutions, and the massive operations of the shadow banking and over-the-counter derivatives markets; and the major provisions of the Dodd–Frank Wall Street Reform and Consumer Protection Act signed into law to in response to the financial crisis and for the purpose of correcting the egregious conduct of major financial institutions. In Daubert v. Merrell Dow Pharmaceuticals, Inc., the U.S. Supreme Court made its first major pronouncement on the evaluation of scientific evidence, calling on judges to act as gatekeepers for scientific knowledge and validity, despite lack of scientific training among judges. Daubert offers the science studies community a case study for examining how judges engage in boundary-work and construct scientific validity. In constructing scientific validity under Daubert, judges must evaluate the scientific method behind a particular scientific claim, and will look (...) to the parties' experts and the relevant scientific community for assistance. To combat the oft-cited problem of the battle of the experts, judges may be tempted to obtain assistance from court-appointed neutral experts, an inquisitorial system in the civil law tradition of many European countries. The judicial evaluation of scientific evidence, the resulting construction of scientific validity, and the push for a greater use of court-appointed experts reveal judges' desire to segregate "objective" scientific facts from aspects of the legal process that are infused with adversaries' values. Yet the scientific and judicial construction of validity mixes empirical results and research methods with the personal, political, and institutional values of judges and scientists. (shrink)

In the famous Correspondence with Clarke, which took place during the last year of Leibniz's life, Leibniz advanced several arguments purporting to refute the absolute theory of space and time that was held by Newton and his followers. The main aim of this book is to reassess Leibniz's attack on the Newtonian theory in so far as he relied on the principle of the identity of indiscernibles. Drawing on rare sources, many of which have not previously been translated into English, the view of Piaget and his work that emerges in this book is very different from the atheistic view of Piaget that is commonly held in psychology and transpersonal psychology. In both his early and later career Piaget held to an evolutionary view of spirituality reminiscent of the work of Hegel and Bergson. The spiritual future could be precursed by the individual in this life through the (...) experience of "Immanence."Piaget underwent a spiritual emergency in adolescence, reported in early autobiographical writing, in which he encountered an array of experiences described in Eastern and Western mystical cannons. For reasons discussed in this book, Piaget attempted to conceal his spiritual inclinations while tacitly confirming them in informal exchanges. This book not only describes the spiritual aspects of Piaget's life and work, it also builds bridges to both the contemporary transpersonal project and to contemporary psychology, by extending Piaget's own ideas to shed new light on transpersonal psychology and transpersonal philosophy, and on the future orientation of general psychology. The book validates the transpersonal project by showing its concerns to be germane to psychology's most influential figure. Bioethics mediators manage a wide range of clinical conflict emanating from diverse sources. Parties to clinical conflict are often not fully aware of, nor willing to express, the true nature and scope of their conflict. As such, a significant task of the bioethics mediator is to help define that conflict. If beliefs are a map by which we steer, then, ceteris paribus, we should want a more accurate map. However, the world could be structured so as to punish learning with respect to certain topics—by learning new information, one’s situation could be worse than it otherwise would have been. We investigate whether the world is structured so as to punish learning specifically about moral nihilism. We ask, if an ordinary person had the option to learn the truth about moral nihilism, (...) ought she to take it? Biobanks hold out the prospect of significant public and private benefit, as genetic information contained in tissue samples is mined for information. However, the storing of human tissue samples and genetic information for research and/or therapeutic purposes raises a number of serious privacy and autonomy concerns. These concerns are compounded when one considers the possibility that a biobank or its owner might go bankrupt. Insolvency impairs the ability of enforcement regimes, and liability-based regimes in particular, to enforce legal norms. The (...) goal of this essay is to develop guideposts for thinking about private and public enforcement of privacy imposed by donors on tissue samples and/or genetic information when a biobank becomes insolvent. Conscious experience has been said to be outside of, or alien to, physics, and unexplained in a physical world. However, it is argued here that experience is entirely expected in a physical world that can only be defined by its power to determine patterns of experience. Something physical is something with the type of causal power that can contribute to determining the content of an experience if a subject is present at the right place and time. Physical powers also interact (...) with other physical powers, distant from any given subject, to form chains, and it is these interactions that physics handles mathematically. Nevertheless, actual causation is always defined by reference to determination of experience. The apparent puzzle of why there should be a link between experience and the physical may relate in part to the fact that experience is always immediately causally proximal, always 'here and now', at least as far as we can ascertain. Proximality, and with it the potential for mentality, cuts across existential/ ontological categories. Experience also requires a concept of an intrinsic individual, in order for there to be individual points of view. The practical problem for consciousness studies is to identify intrinsically individual causal units with event domains in human brains, that can have points of view and content that could fit with human experiences, in a way consistent with current physics. It is suggested that the 'causal diamond' concept of the here and now explored by Savitt (2015) and Arthur (2019), together with principles of field theory, may provide a useful starting point. This article describes, analyzes, and advocates for management of clinical healthcare conflict by a process commonly referred to as bioethics mediation. Section I provides a brief introduction to classical mediation outside the realm of clinical healthcare. Section II highlights certain distinguishing characteristics of bioethics mediation. Section III chronicles the history of bioethics mediation and references a number of seminal writings on the subject. Finally, Section IV analyzes barriers that have, thus far, limited the widespread implementation of bioethics mediation.

It is proposed that a human conscious experience of the sort we report to each other reflects a direct causal interaction between a pattern of information about the world, encoded in a field of postsynaptic potentials, and a quantized mode of excitation occupying dendritic cytoskeleton. The requirement for a quantized account is seen simply as the need for an event of experience to be a single indivisible, but richly patterned, causal relation between information and an 'informee'. It is argued that (...) the informee is likely to be a higher-order quantized collective mode (much as proposed by Craddock and colleagues, 2017) with the biologically relevant dynamics likely also to be describable in classical terms. No specific interpretation of quantum theory is needed. In this scenario, anaesthetics would abrogate reportable experience by detuning parameters underpinning cytoskeletal informee modes, perhaps critically increasing associated impedence. It is also proposed that tuning and detuning of informee modes in individual dendritic trees by binding of accessory proteins to cytoskeleton plays a physiological role in short-term memory and truth evaluation through ascertainment of sequential signal pattern consonance. Components of this model may be involved in cellular adaptive responses in many types of organism. (shrink)

This paper assesses possible reasons why Hermann J. Muller avoided peer-review of data that became the basis of his Nobel Prize award for producing gene mutations in male Drosophila by X-rays. Extensive correspondence between Muller and close associates and other materials were obtained from preserved papers to compliment extensive publications by and about Muller in the open literature. These were evaluated for potential historical insights that clarify why he avoided peer-review of his Nobel Prize findings. This paper clarifies the basis (...) of Muller’s (Muller HJ, Sci 66 84-87, 1927c) belief that he produced X-ray induced “gene” mutations in Drosophila. It then shows his belief was contemporaneously challenged by his longtime friend/confidant and Drosophila geneticist, Edgar Altenburg. Altenburg insisted that Muller may have simply poked large holes in chromosomes with massive doses of X-rays, and needed to provide proof of gene “point” mutations. Given the daunting and uncertain task to experimentally address this criticism, especially within the context of trying to become first to produce gene mutations, it is proposed that Muller purposely avoided peer-review while rushing to publish his paper in Science to claim discovery primacy without showing any data. The present paper also explores ethical issues surrounding these actions, including those of the editor of Science, James McKeen Catell and Altenburg, and their subsequent impact on the scientific and regulatory communities. This historical analysis suggests that Muller deliberately avoided peer-review on his most significant findings because he was extremely troubled by the insightful and serious criticism of Altenburg, which suggested he had not produced gene mutations as he claimed. Nonetheless, Muller manipulated this situation (i.e., publishing a discussion within Science with no data, publishing a poorly written non-peer reviewed conference proceedings with no methods and materials, and no references) due to both the widespread euphoria over his claim of gene mutation and confidence that Altenburg would not publically challenge him. This situation permitted Muller to achieve his goal to be the first to produce gene mutations while buying him time to later try to experimentally address Altenburg’s criticisms, and a possible way to avoid discovery of his questionable actions.
